В статье исследуются теоретические и практические аспекты участия некоммерческих организаций в системе оказания юридической помощи населению Российской Федерации. Анализируются доктринальные подходы к определению понятия, сущности, форм и видов юридической помощи, а также особенности правового статуса некоммерческих организаций как субъектов правозащитной деятельности. Автор выделяет две группы НКО, участвующих в оказании юридической помощи: профессиональные организации (адвокатские палаты, адвокатские образования, нотариальные палаты), созданные исключительно для этих целей, и правозащитные организации, осуществляющие такую деятельность в рамках более широких уставных целей. Выявляются системные проблемы, препятствующие эффективному участию НКО в оказании юридической помощи: отсутствие единых квалификационных требований к лицам, оказывающим помощь в рамках правозащитных организаций; недостаточное и неравномерное финансирование системы бесплатной юридической помощи; пробелы в законодательстве, в частности нераспространение права на бесплатную помощь на юридические лица; организационная разобщённость и отсутствие координации между государственными структурами и НКО. Делается вывод о необходимости комплексного подхода к решению выявленных проблем, сочетающего законодательные изменения, организационные меры и цифровизацию, что позволит повысить доступность и качество юридической помощи для социально уязвимых категорий граждан.

The article examines the theoretical and practical aspects of the participation of non‑profit organizations in the system of providing legal assistance to the population of the Russian Federation. The author analyzes doctrinal approaches to defining the concept, essence, forms and types of legal assistance, as well as the features of the legal status of non‑profit organizations as subjects of human rights activities. Two groups of non‑profit organizations involved in the provision of legal assistance are distinguished: professional organizations (bar associations, bar formations, notary chambers) created exclusively for these purposes, and human rights organizations that carry out such activities within the framework of broader statutory goals. Systemic problems hindering the effective participation of non‑profit organizations in the provision of legal assistance are identified: the absence of uniform qualification requirements for persons providing assistance within human rights organizations; insufficient and uneven funding of the free legal aid system; gaps in legislation, in particular the non‑extension of the right to free assistance to legal entities; organizational fragmentation and lack of coordination between state structures and non‑profit organizations. It is concluded that an integrated approach is needed to address the identified problems, combining legislative changes, organizational measures and digitalization, which will improve the accessibility and quality of legal assistance for socially vulnerable categories of citizens.
