<p>The article discusses the problem of legal regulation of neurotechnology and neurodata in the Russian Federation. The relevance of the research is due to the rapid development of neurotechnologies that expand the possibilities for recording, analyzing and manipulating human brain activity, which poses significant risks to the mental integrity of the individual, cognitive freedom and privacy. The paper analyzes the provisions of Federal Law №. 152-FZ "On Personal Data" and Federal Law №. 323-FZ "On Public Health Protection" in relation to the legal status of neural data. The author concludes that current Russian legislation does not classify neural data into a separate category of information with a special legal regime, which creates legal uncertainty: neural data can simultaneously be classified as biometric personal data, health information, or medical secrets, which entails different requirements for their processing and protection. The article substantiates the need to consolidate neural data as a special category of personal data requiring enhanced legal protection. The article analyzes approaches to the formation of the institute of neuro‑law in international law and foreign legislation, in particular, the experience of Chile, the United States and UNESCO recommendations. The author suggests the formation of a special legal category covering such rights as mental integrity, cognitive freedom, and mental self-determination, as well as an expanded interpretation of existing rights to respect for privacy, personal dignity, and freedom of thought. It is concluded that neuro‑law should be considered as a logical development of the current law aimed at protecting the mental integrity of the individual in the context of digital transformation.</p>
<kwd-group xml:lang="ru"><kwd>нейротехнологии</kwd><kwd>нейроданные</kwd><kwd>персональные данные</kwd><kwd>биометрические данные</kwd><kwd>нейроправа</kwd><kwd>психическая целостность</kwd><kwd>когнитивная свобода</kwd></kwd-group><kwd-group xml:lang="en"><kwd>neurotechnology</kwd><kwd>neuro-data</kwd><kwd>personal data</kwd><kwd>biometric data</kwd><kwd>neuro‑law</kwd><kwd>mental integrity</kwd><kwd>cognitive freedom</kwd></kwd-group></article-meta></front><back><ref-list><ref id="ref1"><mixed-citation publication-type="other" xml:lang="ru">[1] Штодина Д. Д. (Works on Intellectual Property). 2024.
