Статья посвящена исследованию правовых проблем, возникающих в связи с развитием вспомогательных репродуктивных технологий и использованием криоконсерви рованного биоматериала после смерти одного из потенциальных родителей. Рассматривают сявопросы определения правовой природы эмбриона и иных репродуктивных материалов, особенности реализации прижизненного волеизъявления пациента, а также проблемы уста новления происхождения ребенка, рожденного в результате постмортальной репродукции. Особое внимание уделяется анализу действующего российского законодательства, правовых позиций Конституционного Суда Российской Федерации, зарубежного опыта правового регу лирования и современных биоэтических подходов. Исследуются вопросы хранения, передачи и утилизации криоконсервированного биоматериала, а также правовые последствия рожде ниядетей после смерти одного из родителей. По результатам исследования сформулированы предложения по совершенствованию российского законодательства, направленные на обеспечение баланса между репродуктивной автономией личности, защитой интересов будуще горебенка и принципом правовой определенности.

The article examines legal issues arising from the development of assisted repro ductive technologies and the use of cryopreserved reproductive material after the death of one of the intended parents. The authors analyze the legal nature of embryos and reproductive material, the implementation of lifetime consent, and the legal status of children born through posthumous repro duction. Particular attention is paid to Russian legislation, the legal position of the Constitutional Court of the Russian Federation, foreign legal experience, and contemporary bioethical approaches. The study also addresses the regulation of storage, transfer, and disposal of cryopreserved repro ductive material, aswell as the legal consequences of posthumous parenthood. Based on the find ings, proposals are formulated to improve Russian legislation in order to balance reproductive autonomy, the interests of the future child, and the principle of legal certainty.
