В статье анализируется проблема разграничения трудовых отношений и гражданско-правовых договоров с участием самозанятых граждан. Исследуются правовые критерии, выработанные судебной практикой и нормативными актами, а также зарубежный опыт противодействия подмене трудовых отношений (Великобритания, Нидерланды). Автор предлагает внедрение в российское законодательство опровержимой презумпции трудовых отношений при наличии совокупности индикаторов, что позволит защитить экономически слабую сторону договора и обеспечить единообразие правоприменения.

This article analyzes the problem of distinguishing between employment relation ships and civil‑lawcontracts involving self‑employed individuals. Itexamines the legal criteria devel oped by judicial practice and regulatory acts, aswell asforeign experience in countering disguised employment in the United Kingdom and the Netherlands. The author proposes introducing a rebut table presumption of an employment relationship into Russian legislation when a set of indicators is present, which would protect the economically weaker party to the contract and ensure uniform enforcement.
